In the matter of Mr Marashi, a person who is or was involved in legal practice but is not a solicitor.

Section 43 Solicitors Act 1974 (as amended)

The Facts

Mr Kelly Marashi, who is not a solicitor was employed by PK Legal as an ImmigrationConsultant, admitted to receiving sums amounting to £3,000 of client's money due to be paidinto his then employer's client account. Ms Aziz, the former principal of PK Legal whichemployed/remunerated Mr Marashi, confirmed that £5,200 of client's money is unaccountedfor. This combined with the information provided by clients of PK Legal indicate that MrMarashi has appropriated sums from clients/not accounted properly or at all for those clientmonies of £5,200. Mr Marashi admitted to having received £1,800 of these client's moniesand keeping it. He has also admitted to receiving a further £700 but did not saywhat he did with it.

Mr Marashi held himself out as a solicitor on a declaration made on behalf of a client. Healso held himself out as a "partnership director" on headed notepaper of a D W Partnershipsolicitor's practice in November 1999. D W Partnership Solicitors had previously closed inAugust 1999 and Mr Marashi continued to write using the firm's notepaper with the formersolicitor's names crossed out after the firm had shut down.

Mr Marashi was made subject to an order pursuant to section 43 of the Solicitors Act 1974on 20 November 2003.

Finding

The Adjudication Panel was satisfied that they have sufficient evidence that firstly Mr Marashi has been employed/remunerated by a solicitor in connection with her practice, and further that Mr Marashi has occasioned (without the connivance of the solicitor to by whom he was employed/remunerated) acts of such default (i.e. misappropriating clients’ monies and holding himself out as a solicitor) that in the Panel's opinion, it would be undesirable for him to be employed in connection with his/her practice.

Order

Pursuant to Section 43(2) of the Solicitors Act 1974 (as amended) it is ordered that with immediate effect, no solicitor shall, except in accordance with permission in writing granted by the Law Society for such a period and subject to such conditions as the Society may think fit to specify in the permission, employ or remunerate in connection with their practice as a solicitor, Kelly Marashi, also known as Kilil Marashi and Khalila Al-Mar'ashi of 15 Beverley Way, London, SW20 0AW.
