Professional misconduct contrary to Core Duty 5 and rC8 of the Code of Conduct of the Bar of England and Wales (1st Edition)
Offence details:

Sophia Cannon, a barrister, behaved in a way likely to diminish the trust and confidence which the public places in the profession by acting in a way that could reasonably be seen by the public to undermine her honesty and integrity by misleading the Family Court on 14 August 2014 in that she:

(1) Informed the court that the Respondent, X, had been served with a copy of the draft order sought at the hearing when she knew, or ought to have known, that he had not been so served; and
(2) Informed the court that X was aware of the application to release a secured fund of £50,000 and had expressed a view about this when she knew, or ought to have known, that he was not aware of the application and had not expressed any view.

Sophia Cannon, a barrister, behaved in a way likely to diminish the trust and confidence which the public places in the profession by failing to comply with the agreements recited within and the orders of District Judge X sitting in the Family Court made on 2 September 2014, 20 November 2014 and 15 January 2015 in that she:

(1) Failed to pay £6,500 to the X School and forward proof of such payment by 12 September 2014 pursuant to the agreement recited in the order dated 2 September 2014;
(2) Failed to pay the balance of the fund for school fees to the Respondent’s, Mr. X’s, solicitors by 12 September 2014 pursuant to the agreement recited in the order dated 2 September 2014;
(3) Failed to send to X’s solicitors a copy of all applications, notes and evidence submitted to the Family Court by 5 September 2014 pursuant to paragraph 3 of the order dated 2 September 2014;
(4) Failed to serve a statement in support of her application for variation of an earlier order by 12 September 2014 pursuant to paragraph 3 of the order dated 2 September 2014;
(5) Failed to comply with paragraph 3 of the said order by 12 December 2014 pursuant to the further order made on 20 November 2014;
(6) Failed to serve on X’s solicitors a receipt for the payment of school fees by 12 December 2014 pursuant to the order made on 20 November 2014;
(7) Failed to file and serve evidence of the payment to X Solicitors of the balance of the fund for school fees by 27 November 2014 pursuant to the order made on 20 November 2014; and
(8) Failed to pay X the costs of the hearing in the Family Court on 20 November 2014 by 29 January 2015 pursuant to a further order made on 15 January 2015.

Sanction:
Prohibited from applying for a practising certificate for 12 months and Disbarred (Sentence came into effect as of 4 April 2023)
