PMR Solicitors Ltd have been granted permission under Section 41 of the Solicitors Act 1974 to employ Mr Andrew Lindsay, subject to the following conditions:

  1. Mr Lindsay’s work will be directly supervised by Mr Smith, and in his absence by Mr Maughan.
  2. Mr Lindsay is permitted to work as a legal assistant. His responsibilities are limited to those described in the firm’s submitted Section 41 Approval of Employment form dated 18 June 2021 and additional emails of 31 August and 3 September 2021.
  3. Mr Lindsay’s supervision is as per the details provided in the firm’s Section 41 Approval of Employment form dated 18 June 2021 and additional email of 18 August 2021.
  4. Mr Lindsay shall not have any responsibility for or be involved in the training or supervision of any other employee at PMR Solicitors Ltd, other than in the capacity outlined by the firm in its email of 3 September 2021.
  5. Mr Lindsay shall not hold, receive, or have access to client money, or act as a signatory to any client or office account, or have the power to authorise electronic transfers from any client or office account.
  6. Any proposed variation to Mr Lindsay’s job description, duties or supervision arrangements is notified to the SRA in advance of the change taking place and must not occur until permission is granted by the SRA. Any proposed change to the composition of the firm is also to be notified in advance to the SRA.
  7. This approval will lapse if Mr Lindsay’s employment with PMR Solicitors Ltd is terminated.
  8. This approval and the conditions attached to it are subject to review at the absolute discretion of the SRA.

Reasons/basis

Mr Lindsay was struck off the roll of solicitors on 29 November 2017. In accordance with Section 41 of the Solicitors Act 1974, any solicitor wishing to employ or remunerate him in connection with their practise as a solicitor must obtain the SRA’s approval. The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.
