Offence details:

Professional misconduct contrary to Core Duty 5 and Core Duty 9 of the Code of Conduct of the Bar of England and Wales (9th Edition), and contrary to paragraph 301 and pursuant to 901 of the (7th and 8th Edition) and rC65.1 of the Code of Conduct of the Bar of England and Wales (9th Edition)

Benjamin Marrache, a barrister engaged in conduct likely to diminish the trust and confidence which the public places in him or in the profession and engaged in a conduct, whether in pursuit of his profession or otherwise, which was dishonest; and likely to diminish public confidence in the legal profession or otherwise bring the legal profession into disrepute, in that, between 1 July 2004 to 9 February 2010, conspired with others to defraud clients of Marrache & Co, for which he was convicted on 4 July 2014 of Conspiracy to defraud under the Common Law of Gibraltar in The Supreme Court of Gibraltar and sentenced to 8 years imprisonment.

Benjamin Marrache, a barrister engaged in conduct likely to diminish the trust and confidence which the public places in him or in the profession and engaged in a conduct, whether in pursuit of his profession or otherwise, which was dishonest; and likely to diminish public confidence in the legal profession or otherwise bring the legal profession into disrepute, in that, between 1 January 2009 to 9 February 2010, conspired with others to defraud clients of Marrache & Co, for which he was convicted on 4 July 2014 of Conspiracy to defraud under the Common Law of Gibraltar in The Supreme Court of Gibraltar and sentenced to 3 years imprisonment.

Benjamin Marrache, a barrister, failed to report promptly or at all to the Bar Standards Board, as required by CD9 and rC65.1 that he had been convicted on 4 July 2014 in The Supreme Court of Gibraltar on two counts of an indictable offence, namely Conspiracy to defraud, contrary to Common Law of Gibraltar.
