Jonathan Oultram, from 13 March 2013 to 5 January 2014, practised as a barrister, without having a practising certificate issued by the Bar Council, contrary to paragraph 202(c) of the Code of Conduct and the Practising Certificate Regulations (Annex D to the Code of Conduct), such failure to comply with the Code being a serious failure, and therefore constituting professional misconduct on his part, pursuant to paragraph 901.5 of the Code because:
1) it amounts to a criminal offence (by section 14 of the Legal Services Act 2007):
2) the failure lasted for 10 months;
3) he failed to respond, when required by the BSB to do so, to an email dated 4 February 2014,requesting his comments on the allegation; and/or
4) he has failed to comply with other provisions of the Code in the past, namely breaches of practising requirements and failures to complete CPD.
