Decision details

Mr Eloket was suspended from practice for an indefinite period by the Solicitors Disciplinary Tribunal on 12 October 2011. In accordance with Section 41 of the Solicitors Act 1974, (the Act) any solicitor wishing to employ or remunerate him in connection with their practise as a solicitor must obtain the SRA’s approval.

On 3 March 2017, DH Law Limited were granted permission under the Act to employ Mr Eloket, subject to a condition that any variation to the terms of his employment must be notified to the SRA.

DH Law Limited have applied to vary the terms of Mr Eloket’s employment as a Paralegal, to allow him to meet with clients on his own. This has been granted subject to the following conditions:

  1. Mr Eloket’s work is directly and closely supervised by Miss Rheian Davies and in her absence, Miss Hannah Jones or Miss Sunita Joshi. Should Miss Davies, Miss Jones or Miss Joshi be absent for any reason, it is their responsibility to ensure that suitable alternative arrangements are made to ensure that Mr Eloket is properly supervised to comply with this decision and Rule 12 of SRA Practice Framework Rules 2011
  2. Mr Eloket is not to be a signatory to any office or client account cheque and will not hold, receive or have any responsibility for clients’ monies or the firm’s accounts functions.
  3. Mr Eloket’s name does not appear on the firm’s headed notepaper, publicity material, web-site or external nameplates (unless the firm is prepared to state unambiguously his status as a person who has been Suspended indefinitely by the Tribunal).
  4. Any proposed variation in Mr Eloket’s job description is notified immediately to the Solicitors Regulation Authority.
  5. Mr Eloket does not undertake any advocacy on behalf of the firm.
  6. This approval is reviewable at the discretion of Solicitors Regulation Authority.
  7. Miss Davies will inform the Solicitors Regulation Authority immediately if there is any change in the composition of the firm and/or practice address is changed and/or there is/are any new practice address(es).
Reasons/basis
The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.
