Reasons/basis

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal.  This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that Mr Kabuye's handling of a number of potentially fraudulent conveyancing matters including, causing or allowing a client account shortage and using the Firm's client account as a banking facility by distributing the proceeds of sale to third parties.

Also that Mr Kabuye demonstrated insufficient control, supervision or oversight of the firm as the Firm's sole Manager and failed to co-operate with the SRA's investigation.

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

Eric Kabuye’s practising certificate for 2022/2023 is subject to the following conditions:

  1. Mr Kabuye is not a manager or owner of any authorised body.
  2. Subject to the condition above, Mr Kabuye may act as a solicitor, only as an employee where the role has first been approved by us.
  3. Mr Kabuye may not act as a Compliance Officer for Legal Practice (COLP) or a Compliance Officer for Finance and Administration (COFA) for any authorised body.
  4. Mr Kabuye does not hold or receive client money, or act as a signatory to any client or office account or have the power to authorise transfers from any client or office account
  5. Mr Kabuye may not provide legal services as a freelance solicitor offering reserved or unreserved services on his own account under Regulation 10.2(a) or (b) of the SRA Authorisation of Individuals Regulations.

In these conditions the terms are as defined in the SRA Glossary.

The above conditions are necessary in the public interest and reasonable and proportionate having regard to the purposes set out in Regulation 7 of the SRA Authorisation of Individuals Regulations and the regulatory objectives and principles governing regulatory activities as contained in section 28 of the Legal Services Act 2007.

Reasons/basis
  1. There is reason to suspect dishonesty by Mr Kabuye in connection with his practice as a solicitor (paragraph 1(1)(a)(i) of Schedule 1 – Part I to the Solicitors Act 1974).
  2. Mr Kabuye has failed to comply with rules (paragraph 1(1)(c) of Schedule 1 – Part I to the Solicitors Act 1974).
