Professional misconduct contrary to Rules rc8, rc65.3, rc65.7 and Core Duty 5 of the Bar Standards
Board’s Handbook (9th Edition).
Offence details:

Giles Robertson acted in a way which was likely to diminish the trust and confidence which the public places in him or in the profession and/or acted in a way which could reasonably be seen by the public to undermine his honesty and/or integrity in that, between September 2015 and July 2016, while in practice as a solicitor, he
misappropriated the sum of £140,731.97 from monies held in a Client Account on behalf of Company T, for which conduct, charges of professional misconduct were
found proved, and Giles Robertson was struck off the Roll of Solicitors by the Solicitors Disciplinary Tribunal in its written decision dated 28 May 2019.

Giles Robertson acted in a way which was likely to diminish the trust and confidence which the public places in him or in the profession and/or acted in a way which could reasonably be seen by the public to undermine his honesty and/or integrity, in that he failed to inform the Bar Standards Board promptly or at all that he was or had been subject to disciplinary, regulatory or enforcement action of another Approved Regulator (namely the Solicitors Regulation Authority), such action consisting of:
(1) the investigation into his activities instigated by the Solicitors Regulation Authority;
(2) the formal allegations of professional misconduct advanced against him by the Solicitors Regulations Authority following that investigation.
(3) the hearing on 8-10 April 2019 at which the Solicitors Disciplinary Tribunal considered those allegations;
(4) the finding of professional misconduct made by the Solicitors Disciplinary Tribunal in its Judgment dated 28 May 2019; and/or
(5) the consequent order to strike him off the Roll of Solicitors.

Giles Robertson acted in a way which was likely to diminish the trust and confidence which the public places in him or in the profession and/or acted in a way which could reasonably be seen by the public to undermine his honesty and/or integrity, in that he failed to inform the Bar Standards Board promptly or at all that he had committed serious misconduct, namely that he (i) had misappropriated the sum of £140,731.97 from monies held in a Client Account on behalf of Company T

Sanction:
Reprimanded and Disbarred (sentence still to take effect)

Prohibited from being issued with a practising certificate under rE227.3 (as an unregistered barrister)

Open to Appeal
