This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which reaches its own decision after considering all the evidence, including any evidence put forward by the Respondent. The Tribunal had certified that there was a case to answer.

The matter was heard on 10 & 11 July 2023.

The SDT found the allegation against Ms Tsang Not Proved and made No Order against her.

The SDT Order is subject to an Appeal to the High Court (Administration Court) by the SRA. The Order remains in force pending the High Court's decision on the Appeal. 

On 23 April 2024, the High Court heard the SRA's appeal before Mr Justice Eyre. The SRA appealed the Solicitors Disciplinary Tribunal decision dated 11 July 2023 whereby the SRA was Ordered to pay Ms Tsang's costs.

On 17 May 2024, the Judgment was handed down and the SRA's appeal was dismissed.
