Sarah Waddington Solicitors Limited has been granted permission under section 41 of the Solicitors Act 1974 to employ Ian Benbow, subject to the following conditions:

  1. Mr Benbow’s work is limited to that described in the Section 41 approval of employment application form dated 29 September 2021 and email dated 14 October 2021.
  2. Mr Benbow is directly supervised by Sarah Waddington. If Miss Waddington is absent for more than one working day Mr Benbow will not undertake any work for clients during the period of absence.
  3. Mr Benbow will not receive or have access to client or office money or be a signatory to any office or client account.
  4. Mr Benbow is permitted to work remotely in line with the supervision arrangements as detailed in the firm's email of 14 October 2021.
  5. The supervision arrangements and job description may not be varied without our prior written approval.
  6. This approval will lapse if Mr Benbow’s employment with the firm is
  7. This approval and the conditions attached to it are subject to review at the absolute discretion of the SRA.

Reasons/basis

Ian Benbow was struck off the roll of solicitors on 21 November 2013. In accordance with section 41 of the Solicitors Act 1974, any solicitor wishing to employ or remunerate him in connection with their practise as a solicitor must obtain the SRA’s approval. The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.
