Julie Burns engaged in conduct which was dishonest or otherwise discreditable to a barrister contrary to paragraph 301(a)(i) of the Code of Conduct in that on 22 December 2009 she was, upon her own confession, convicted upon indictment at Southwark Crown Court of two counts of fraud by abuse of position; one count of dishonestly making false representations and one count of obtaining property by deception. As a result of the conviction, Julie Burns was sentenced, on 29 January 2010, to 3 years imprisonment.
Julie Burns failed to report promptly to the Bar Council that she had been convicted on 22 December 2009 of a relevant criminal offence as defined in Part 10 of the Code of Conduct, such failure being contrary to paragraph 905(b)(ii) of the Code of Conduct. Such criminal offence being two counts of fraud by abuse of position contrary to Section 4 of the Fraud Act 2006; one count of dishonestly making false representations position contrary to Section 2 of the Fraud Act 2006 and one count of obtaining property by deception contrary to Section 15(1) of the Theft Act 1968.
