Professional misconduct pursuant to paragraphs 301(a)(i), 301 (a) (iii) and 901.7 of the Code of Conduct of the Bar of England and Wales (8th Edition)
Offence details:

Merilyn Brown, a barrister, engaged in conduct which was dishonest or otherwise discreditable to a barrister in that with the intention of making a financial gain and/or an advantage for herself in obtaining part-time employment and engaged in conduct which was likely to diminish public confidence in the legal profession or otherwise bring the legal profession into disrepute in that with the intention of making a financial gain and/or an advantage for herself in obtaining part-time employment:

(1) In or about June/July 2012, Merilyn Brown

completed and submitted a written application for

for employment as Head of Legal Services with X

Hospital, in which she:

(a) falsely replied ?No? to the question ?Have you ever been dismissed from previous employment??, when she had been dismissed in or about September 2010 as Head of Complaints and Litigation at X NHS Trust;

(b) falsely stated that her reason for leaving X NHS Trust was it was an ?interim role?;

(c) falsely certified that the information given by her on the application form for employment was correct.

Merilyn Brown, a barrister, engaged in conduct which was dishonest or otherwise discreditable to a barrister in that on or about 19th October 2012, Merilyn Brown informed JW, Assistant Director of Nursing and Patient Experience at X Hospital, that she was working at X NHS Trust, in a part-time capacity only when in truth she was working full-time at X NHS Trust with one day a week working from home.
