Decision details

AP Berkeley Limited have been granted permission under Section 41 of the Solicitors Act 1974 to employ Mr Mohammed Farooq Rafiq as a caseworker, subject to the following conditions:

  1. 1. Mr Ruparelia’s work will be supervised by Ayesha Qureshi (SRA number 523924).
  2. In the event of Ms Qureshi’s absence, Mr Ruparelia will have to stop working immediately and will not be able to return to work until Ms Qureshi has returned.
  3. Mr Ruparelia is not to represent clients and is only able to act as a second chair.
  4. Mr Ruparelia’s employment is limited to that outlined by the firm in its application of 17 May 2022 and subsequent emails of 18 July 2022, 9 August 2022, 18 May 2023, 22 May 2023, 5 June 2023 and 17 April 2024.
  5. Mr Ruparelia’s supervision, with the exception of condition 6 below, is as per the details provided to us by the firm in its application of 17 May 2022 and subsequent emails of 18 July 2022, 9 August 2022, 18 May 2023, 22 May 2023, 5 June 2023 and 17 April 2024.
  6. Monthly appraisals of Mr Ruparelia’s work will be carried out.
  7. Mr Ruparelia will not be responsible for the supervision of any other staff.
  8. Mr Ruparelia does not have access to any office or client account, is not a signatory to any office or client account and does not have any responsibility for the Firm’s accounting functions.
  9. The SRA is immediately informed of any proposed variation in Mr Ruparelia’s duties or his supervision arrangements, prior to any such variation taking place. Any variation must not take place until permission is granted by the SRA.
  10. This approval will lapse if Mr Ruparelia’s employment with the Firm is terminated or if he leaves the Firm.
  11. This approval and the conditions attached to it are subject to review at the discretion of the SRA.
Reasons/basis

Minesh Ruparelia was struck of the roll of solicitors on 16 January 2001. In accordance with Section 41 of the Solicitors Act 1974, any solicitor wishing to employ or remunerate him in connection with their practise as a solicitor must obtain the SRA's approval. The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.
