Paragraphs 202(c), 905(d) and 901.5 of the Code of Conduct of the Bar of England and Wales (8th Edition)
Offence details:

Nigel Daniel, having been called to the Bar on 22 November 1988, practised as a barrister between 1 January 2011 and 19 September 2011 without having a practising certificate issued by the Bar Council contrary to paragraph 202(c) of the Code of Conduct and the Practising Certificate Regulations (Annex D to the Code of Conduct). This failure was serious and therefore constitutes professional misconduct pursuant to paragraph 901.5 by virtue of its nature including that carrying out reserved legal activities without being authorised to do so constitutes a criminal offence pursuant to s14 of the Legal Services Act 2007.

Nigel Daniel, having been called to the Bar on 22 November 1988 and having been asked to provide comments or information by the Bar Standards Board on a complaint in letters dated 3 May 2011, 1 June 2011 & 15 July 2011, and having been reminded of his duty to respond promptly to any request for comments or information, pursuant to paragraph 905(d) of the Code of Conduct, failed to respond promptly and/or at all to said request. Such failure to provide comments and/or information as requested, by virtue of its combination with another failure to comply with the Code of Conduct (being the failure which is the subject of Charges 1 of this Charge Sheet), being so serious as to constitute professional misconduct.
