Robert Gordon Lennox O?Reilly Apsion, on or about 7th June 2007 drafted a letter for his client X to send to the Area Director of the Regional County Court Services in terms and language that were improper, discreditable to a barrister, prejudicial to the administration of justice or were likely to diminish public confidence in the legal profession or the administration of justice or otherwise bring the legal profession into disrepute.

Robert Gordon Lennox O?Reilly Apsion, on or about 23rd March 2007 accepted instructions to act for X in respect of an appeal from a County Court judgment in circumstances that caused him to be professionally embarrassed by reason of the fact that he lacked sufficient experience and competence to conduct such an appeal.

Robert Gordon Lennox O?Reilly Apsion, on or about 23rd March 2007 failed to act courteously or with reasonable competence or to take all reasonable and practicable steps to avoid unnecessary expense or waste of the Court?s time by advising X to make an inappropriate application to set aside a County Court judgment and/or by pursuing such application in intemperate terms after the Court had informed X that such course was inappropriate.

Robert Gordon Lennox O?Reilly Apsion, having bankruptcy proceedings initiated against him on a date unknown prior to 26th April 2007 and having been adjudicated bankrupt on 26th April 2007 by the Bankruptcy Court in the High Court of Justice, failed promptly to report to the Bar Standards Board (i) the initiation of the said proceedings or (ii) the fact of the said adjudication.

Robert Gordon Lennox O?Reilly Apsion, having been adjudicated bankrupt on 26th April 2007 as aforesaid, demanded and received from his client on about 8th May 2007 a sum of ?5,875 purportedly in respect of fees without informing her of the said adjudication, thereby engaging in conduct discreditable to a barrister, prejudicial to the administration of justice or likely to diminish public confidence in the legal profession or the administration of justice or otherwise bring the legal profession into disrepute.

Robert Gordon Lennox O?Reilly Apsion, having on 14th June 2007 had his practising certificate suspended with immediate effect and been suspended from undertaking public access work indefinitely, continued in several occasions thereafter until about 20th August 2007 to accept instructions from, and purport to provide services as a barrister, to X on a public access basis.
