Paragraphs 901.2, 901.4, 905(d) of the Code of Conduct (8th Edition).
Offence details:

Toby Pomeroy practised as a barrister having failed to complete the prescribed 12 hours Established Practitioners Programme and/or complete the record card by 31 January 2006, contrary to the requirements of paragraph 202(b) of the Code of Conduct and Annex C of the Continuing Professional Development regulations and, having been informed of the need to complete the hours by letter dated 20 February 2006, failed to take the necessary actions to cure the non-compliance and/or having failed to pay a financial penalty imposed on him on 4 October 2006 within the time limit prescribed namely on or before 1 November 2006.

Toby Pomeroy, having been given 28 days to pay a financial penalty of ?100 imposed on him on 4 October 2006 in accordance with paragraph 901.1, failed to pay the said financial penalty by the due date of 1 November 2006.

Toby Pomeroy failed to respond promptly to requests from the Bar Standards Board for comments or information on a complaint, in that he failed to respond to letters sent to him by the Bar Standards Board dated 30 November 2006 and 15 January 2007, such failure being, by virtue of its combination with other failures to comply with the Code (being the failures which are the subject of Charges 1, 2 and 4 in this Charge Sheet or any one or more of the said Charges), so serious as to be likely to bring the Bar into disrepute.

Toby Pomeroy failed to respond promptly to letters of notification, dated 18 May 2007, sent to him pursuant to rules 3 to 5 of the Summary Procedure Rules referred to at paragraph 903(c) of the Code, such failure being, by virtue of its repetition and combination with other failures to comply with the Code (being the failures which are the subject of Charges 1, 2 and 3 in this Charge Sheet or any one or more of the said Charges), so serious as to be likely to bring the Bar into disrepute.

Sanction:
Disbarred and suspended pending any appeal.
